Participation and Terms of Use Agreement
Please read the following information carefully before proceeding.
Guiding Good Choices – Self-Guided Version (eGGC) is a program of the University of Washington Center for Communities That Care (“UW”) being offered in partnership with Kaiser Permanente Northern California (KPNC), Kaiser Permanente Colorado (KPCO), and Henry Ford Health System (HFHS). The primary goals of the program are to enhance positive parent-child interactions and provide parents with information, tools, and skills that prevent substance use and other behavioral health problems in their children.
eGGC is the intellectual property of UW; the original version was created by J. David Hawkins and Richard F. Catalano. It is protected by copyright law, international treaties and this Terms of Use Agreement, which contains the terms and conditions that pertain to your use of eGGC as set forth below.
By using the website and/or creating a user account, I acknowledge that I have read and agree to the following conditions (“Terms”) and that they are a legally binding agreement:
As an eGGC user, you agree:
All materials published on the eGGC website and in its resources are protected by copyright or other intellectual property rights and are owned or controlled by UW, except as noted.
- eGGC is not intended to diagnose, treat, or otherwise address any medical problem in you or your children nor to serve as a substitute for professional medical advice. Always seek the advice of a qualified healthcare provider with any questions about medical conditions or symptoms.
- Any information you post or transmit to the eGGC website is solely associated with your participation and activities related to eGGC. Postings may be accessed and shared by GGC staff from UW, KPNC, KPCO, and HFHS for the purpose of assisting you in the use of eGGC.
- Any information you post or transmit in using the eGGC website is done so by you voluntarily. Our use and disclosure of an individual’s personal information is limited as required by state and federal law. We do not sell or rent personal information about users of eGGC. For details about the collection and use of your personal information, please see our Privacy Statement.
- eGGC staff do not routinely monitor specific information posted by you in response to any exercises and/or activities that are part of the eGGC curriculum. If you or your children are experiencing a crisis, call 911. Do not contact GGC staff in lieu of emergency medical assistance offered through 911.
- GGC staff from UW, KPNC, KPCO, HFHS may monitor information posted to eGGC for the purpose of assessing use of eGGC as an instructional resource and curriculum-based activity. They may also publish anonymized, aggregated data from users in reports or publications about eGGC.
- In using the product, you agree to the processing and storage of your personal information for the purpose of tracking use. Your activity or inactivity on eGGC may also prompt contact by an eGGC coach for the purpose of supporting your use of the program. We will take measures as required to comply with applicable United States law regarding the transfer, storage and use of certain personal information. By agreeing to these terms you are agreeing to the United States standards for privacy protection.
- eGGC is provided on an “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NONINFRINGEMENT OF INTELLECTUAL PROPERTY, AND IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
- The entire risk for use of eGGC lies with you. UW reserves the right to modify eGGC, or reduce or discontinue access at any time and for any reason.
- You hereby release UW, KPNC, KPCO, and HFHS and their regents, employees, and agents forever from any suits, actions, claims, liabilities, demands, damages, losses, or expenses (including reasonable attorneys and investigative expenses) relating to or arising out of your use of eGGC.
- You shall defend, indemnify, and hold harmless UW, KPNC, KPCO, and HFHS and its officers, developers, employees, students, and agents, against any and all claims, suits, losses, damages, costs, fees, and expenses resulting from your use of the Materials. UW, KPNC, KPCO, and HFHS WILL NOT BE LIABLE DIRECTLY OR INDIRECTLY FOR ANY PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, INTERRUPTION OF BUSINESS, LOSS OF PROFITS, OR OTHER SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED, WHETHER FOR BREACH OF WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE. IN NO EVENT WILL THE UW’S TOTAL LIABILITY FOR THE BREACH OR NON PERFORMANCE OF THIS AGREEMENT EXCEED THE AMOUNT OF PAYMENTS MADE TO UW FOR THE USE OF THESE MATERIALS. THIS LIMITATION WILL APPLY TO CONTRACT, TORT, AND ANY OTHER CLAIM OF WHATEVER NATURE. This indemnification clause shall survive the termination of this Agreement. (Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this exclusion and limitation may not apply to You).
You shall not:
- Distribute, reproduce, display or perform or share eGGC with any third party for any purpose;
- Reproduce without permission any eGGC materials other than for your own use;
- Modify audio-visual eGGC resources or create derivatives of any eGGC resources.
We may revise these Terms from time to time as we add new features to eGGC, modify the way in which we manage information, or as laws change that may affect eGGC and our services. If we make material changes to the Terms, we will post notice of this on the eGGC website prior to the changes becoming effective. We include a version date on this Agreement consisting of the month and year it was last revised. We encourage you to periodically reread this Agreement to see if there have been any changes to our policies that may affect you.
This Agreement constitutes the entire Agreement concerning your use of the Materials. This Agreement is made in and shall be governed by the laws of the State of Washington, without giving effect to the conflict of laws principles thereof. Any suit, action, or proceeding arising out of or relating to this Agreement shall be decided in the state and federal courts of King County, Washington, United States of America.
By using the website and/or creating a user account, you will receive access for a term of 1 (one) year from date of creating the account. You may renew your access by emailing us through the Contact Us form on the website.
